Terms & Conditions of Service

Go Auto Freight LLC Transportation Brokerage Agreement governing vehicle, freight, and logistics services across the United States.

Company Information

Welcome to Go Auto Freight LLC (“Go Auto Freight,” “GAF,” “we,” “us,” or “our”).

Go Auto Freight LLC is a transportation brokerage company that arranges transportation services for vehicles, freight, equipment, machinery, and other property through independent, authorized motor carriers and transportation providers.

These Terms & Conditions of Service (“Terms”) govern your use of Go Auto Freight’s transportation brokerage and logistics services.

By requesting a quote, submitting a shipment, placing or approving an order, authorizing transportation, making a payment, or otherwise using our services, you acknowledge that you have read, understood, and agreed to these Terms, together with any applicable Order Confirmation, invoice, rate confirmation, or other written agreement applicable to your shipment.

If you accept these Terms on behalf of another person, company, dealership, shipper, consignee, or legal entity, you represent and warrant that you have authority to bind that party to these Terms.

Definitions

Customer:

“Customer” means any individual, business, dealership, shipper, consignee, vehicle owner, freight owner, or authorized representative requesting or receiving services from Go Auto Freight.

Broker:

“Broker” means Go Auto Freight LLC when acting as a transportation broker by arranging, or offering to arrange, transportation of property through authorized motor carriers.

Carrier:

“Carrier” means the independent motor carrier or transportation provider selected to physically transport the Customer’s vehicle, freight, equipment, machinery, or other property.

Shipment:

“Shipment” means any vehicle, freight, equipment, machinery, goods, commodities, or other property that Go Auto Freight arranges to be transported.

Order:

“Order” means the Customer’s request for Go Auto Freight to arrange transportation or related logistics services.

Order Confirmation:

“Order Confirmation” means a written or electronic confirmation issued by Go Auto Freight containing applicable shipment information, including origin, destination, shipment description, estimated transportation dates, services, and quoted charges.

Additional Services:

“Additional Services” means services beyond the originally quoted transportation arrangement, including expedited transportation, enclosed transportation, top-load service, special equipment, storage, re-delivery, oversized shipment handling, towing, winching, inoperable vehicle service, additional stops, permits, escorts, detention, or other services requested or reasonably required for the shipment.

Go Auto Freight’s Role as a Transportation Broker

Go Auto Freight operates as a transportation broker and arranges transportation through independent, authorized motor carriers.

Unless expressly agreed otherwise in a separate written agreement, Go Auto Freight does not physically transport, possess, handle, or take custody of the Customer’s Shipment.

The Carrier selected for a Shipment is responsible for physically picking up, transporting, securing, handling, and delivering the Shipment.

The Carrier may issue its own Bill of Lading, inspection report, rate confirmation, transportation agreement, tariff, delivery receipt, or other documents governing the physical transportation of the Shipment.

Go Auto Freight may select or substitute a Carrier based on availability, equipment, route, location, price, service requirements, Carrier qualifications, and other commercially reasonable considerations.

Go Auto Freight does not guarantee that a particular Carrier will be assigned unless that Carrier has been specifically confirmed in writing.

Quotes, Estimates, and Order Confirmation

Quotes and estimates provided by Go Auto Freight are based on information supplied by the Customer and transportation conditions reasonably anticipated when the quote is issued.

A quote is not necessarily a final or guaranteed transportation rate until the shipment is confirmed in writing.

Rates may change when:

  • Shipment information changes;
  • Actual weight or dimensions differ from the information provided;
  • Pickup or delivery conditions differ from those represented;
  • Special equipment is required;
  • The shipment is oversized or overweight;
  • The vehicle is inoperable or otherwise difficult to load;
  • Additional services are requested or required; or
  • Carrier or third-party charges are incurred.

A transportation arrangement becomes confirmed when Go Auto Freight provides an Order Confirmation or otherwise confirms the booking in writing.

The Customer is responsible for reviewing the Order Confirmation and promptly notifying Go Auto Freight of any inaccurate information.

Customer Responsibilities

The Customer must provide complete and accurate information necessary to arrange transportation.

Depending on the Shipment, this information may include:

  • Pickup address
  • Delivery address
  • Contact information
  • Vehicle year, make, and model
  • Vehicle Identification Number (VIN)
  • Vehicle condition
  • Operable or inoperable status
  • Freight description
  • Quantity, Weight & Dimensions
  • Packaging information
  • Loading and unloading requirements
  • Equipment requirements
  • Oversized or overweight conditions
  • Mechanical problems & Vehicle modifications
  • Special access requirements
  • Hazardous-material information
  • Permit or routing information known to the Customer
  • Any other information reasonably necessary to arrange transportation

If information provided by the Customer is inaccurate, incomplete, misleading, or materially changes after booking, Go Auto Freight or the Carrier may modify the transportation arrangement, impose applicable additional charges, delay the Shipment, require additional services, or cancel the Order.

Vehicle Transportation Requirements

For vehicle transportation, the Customer must accurately disclose whether the vehicle is:

  • Operable or inoperable;
  • Running or non-running;
  • Modified;
  • Lifted or lowered;
  • Equipped with oversized wheels or tires;
  • Equipped with aftermarket accessories;
  • Equipped with racks or externally mounted equipment;
  • Damaged;
  • Missing wheels or other components;
  • Oversized; or
  • Otherwise difficult or unsafe to load, transport, or unload.

Additional charges may apply to inoperable, oversized, modified, specialty, damaged, or difficult-to-load vehicles.

A Carrier may refuse or discontinue transportation when a vehicle cannot be safely or lawfully loaded, transported, or unloaded.

Vehicle Preparation

Before pickup, the Customer is responsible for reasonably preparing the vehicle for transportation. The Customer should:

  • Remove loose personal belongings and unsecured accessories;
  • Remove externally mounted luggage, cargo carriers, or racks unless approved;
  • Disable alarms or provide instructions for disabling them;
  • Ensure the vehicle is accessible for inspection and loading;
  • Provide all necessary keys;
  • Inform Go Auto Freight and the Carrier of known mechanical problems;
  • Disclose modifications or special conditions;
  • Maintain a reasonable fuel level;
  • Remove prohibited or hazardous property; and
  • Ensure the vehicle is available at the agreed pickup location.

The Customer may be responsible, to the extent permitted by applicable law, for losses, delays, charges, or damage resulting from undisclosed defects, unsecured components, loose accessories, or improper preparation.

Personal Property Inside Vehicles

Personal property placed inside a vehicle is transported at the Customer’s risk unless otherwise expressly agreed in writing and permitted by the Carrier.

The Customer should disclose any personal property before pickup.

Prohibited High-Value Items:

Customers should NOT place cash, currency, jewelry, firearms, ammunition, weapons, controlled substances, medication, legal documents, negotiable instruments, antiques, irreplaceable property, or other high-value or prohibited items inside a transported vehicle.

Go Auto Freight does not provide insurance coverage for personal belongings placed inside a vehicle unless specifically agreed in writing.

The Carrier may refuse personal property that is unsafe, prohibited, excessive, improperly secured, undeclared, or otherwise not permitted by applicable law or Carrier requirements.

Prohibited Property and Hazardous Materials

The Customer shall not tender illegal, prohibited, hazardous, undeclared, or improperly packaged property for transportation.

Prohibited property may include:

  • Explosives;
  • Ammunition;
  • Illegal drugs or controlled substances;
  • Flammable materials;
  • Undeclared hazardous materials;
  • Contraband;
  • Illegal goods;
  • Live animals unless specifically authorized; and
  • Any other property prohibited by applicable law, regulation, or Carrier requirements.

The Customer may be responsible, to the extent permitted by law, for fines, penalties, damages, losses, delays, claims, or expenses arising from prohibited, illegal, hazardous, or improperly declared property.

Pickup and Delivery

Go Auto Freight and the Carrier will make commercially reasonable efforts to provide transportation to and from the requested locations.

The requested pickup or delivery address may need to be changed when the location is inaccessible, unsafe, or unsuitable for the Carrier’s equipment.

Potential access limitations include: narrow roads, low bridges, low-hanging wires or trees, construction, road closures, weight restrictions, parking restrictions, municipal regulations, traffic conditions, unsafe access, steep or unsuitable roads.

If the Carrier cannot safely access the requested location, the Customer may be required to meet the Carrier at a nearby safe and accessible location.

Any additional transportation, towing, shuttle, storage, waiting, or related charges resulting from access problems may be charged to the Customer when applicable.

Estimated Pickup and Delivery Dates

Pickup and delivery dates and timeframes provided by Go Auto Freight are estimates unless a specific guaranteed service has been expressly confirmed in writing.

Transportation schedules may be affected by: weather, traffic, mechanical problems, driver availability, carrier equipment, road closures, government regulations, accidents, port or terminal delays, loading/unloading delays, driver hours-of-service requirements, other shipments on route, and circumstances beyond Go Auto Freight’s reasonable control.

Go Auto Freight does not guarantee an exact pickup or delivery date unless a specific guaranteed service has been confirmed in writing.

Inspection and Bill of Lading

The Customer or Customer’s authorized representative should inspect the Shipment with the Carrier at pickup.

For vehicle transportation, pre-existing damage should be recorded on the Carrier’s inspection report or Bill of Lading.

At delivery, the Customer should carefully inspect the Shipment before signing the final delivery documentation.

Visible damage should be clearly documented on the Bill of Lading or delivery receipt before signing whenever reasonably possible.

Customers are strongly encouraged to photograph the Shipment at pickup and delivery and retain copies of all transportation documents.

The Customer should not sign documentation stating that the Shipment was received in satisfactory condition if visible damage has not been properly documented.

Loss, Damage, and Cargo Claims

Go Auto Freight acts as a transportation broker and, unless otherwise expressly agreed in writing, does not physically transport, possess, handle, or take custody of the Customer’s Shipment.

Claims involving physical loss or damage occurring during transportation should generally be directed to the Carrier that physically transported the Shipment, subject to applicable federal and state law, the Carrier’s insurance coverage, and the applicable transportation documents.

Go Auto Freight may reasonably assist the Customer with communication and documentation concerning a Carrier claim but does not act as the Carrier’s insurer or claims adjuster unless separately authorized or required by law.

The Customer should preserve: photographs, inspection reports, Bills of Lading, delivery receipts, repair estimates, receipts, and other evidence relating to the claim.

Nothing in these Terms is intended to waive, eliminate, or restrict any right or remedy that cannot legally be waived or restricted.

Carrier Insurance

Go Auto Freight may arrange transportation through independent Carriers that maintain insurance required by applicable law and their operating authority.

Carrier insurance coverage may vary depending on the Carrier, commodity, Shipment, circumstances, policy terms, deductibles, exclusions, and applicable law.

Customers may request available information regarding the Carrier’s applicable insurance before transportation.

Carrier insurance may not cover personal property, pre-existing damage, mechanical failures, excluded commodities, improper preparation, or other losses excluded under the applicable policy.

Freight, Machinery, and Heavy Equipment

For freight, machinery, construction equipment, agricultural equipment, industrial equipment, vehicles, and other commercial shipments, the Customer must provide accurate information concerning: commodity description, weight, dimensions, quantity, packaging, loading/unloading requirements, equipment requirements, pickup/delivery requirements, hazardous-material information where applicable, known permit or routing requirements.

Oversized, overweight, wide, tall, long, or specialized shipments may require special equipment, permits, escorts, routing, or other services.

Additional charges may apply when the actual Shipment materially differs from the information provided at booking.

Additional Charges and Accessorial Services

Additional charges may apply when circumstances require services beyond the original quotation, including:

  • Incorrect or incomplete shipment information;
  • Oversized or overweight freight;
  • Inoperable vehicles;
  • Special equipment, towing or winching;
  • Storage, redelivery, additional stops;
  • Waiting time or detention;
  • Failed pickup or delivery;
  • Restricted access, permits, escorts, tolls;
  • Carrier-assessed charges, Customer-requested changes.

Where reasonably practicable, Go Auto Freight will notify the Customer of material additional charges before they are incurred.

Payment Terms

The Customer agrees to pay all charges specified in the applicable Order Confirmation, invoice, or other written payment agreement.

Brokerage charges and other amounts become due according to the payment terms communicated to the Customer.

Carrier charges, including COD or delivery-payment arrangements, may be subject to the Carrier’s separate payment requirements.

The Customer shall not withhold undisputed amounts due to Go Auto Freight because of a separate claim, delay, damage dispute, or disagreement with a Carrier.

To the extent permitted by applicable law, unpaid balances may result in collection costs, reasonable attorneys’ fees, interest, and other legally recoverable expenses.

Cancellation Policy

The Customer may request cancellation before Carrier acceptance, subject to the applicable Order Confirmation and any applicable cancellation terms.

After a Carrier has accepted an Order, been dispatched, committed equipment, arrived at pickup, or incurred expenses, cancellation and other charges may apply.

Potential charges may include: brokerage cancellation charges, carrier cancellation charges, dry-run charges, dispatch charges, waiting or detention charges, storage charges, redelivery charges, and other reasonable third-party charges already incurred.

The applicable cancellation amount may depend on the status of the Shipment and the terms stated in the applicable Order Confirmation.

Refunds

Refunds will be determined according to the applicable Order Confirmation, services actually performed, third-party charges incurred, payment terms, and applicable law.

Where a service has not been performed and a refund is otherwise legally or contractually due, Go Auto Freight will refund the applicable unearned amount.

Third-party Carrier charges or other expenses already incurred may be non-refundable.

Storage and Redelivery

If delivery cannot be completed because of the Customer’s refusal or failure to accept delivery, inaccurate information, inaccessible location, unpaid charges, failure to provide required access, or another circumstance attributable to the Customer, the Shipment may be placed in storage or otherwise handled by the Carrier.

The Customer may be responsible for applicable storage, redelivery, transportation, waiting, detention, and other reasonable charges.

Delays and Force Majeure

Go Auto Freight shall not be responsible for failure or delay caused by circumstances beyond its reasonable control, including: severe weather, floods, fire, natural disasters, accidents, traffic, road closures, government action, regulatory restrictions, port congestion, labor disruptions, mechanical failures, driver availability, acts of war, terrorism, civil unrest.

Go Auto Freight and the Carrier will make commercially reasonable efforts to minimize delays caused by such circumstances.

Customer Representations and Warranties

The Customer represents and warrants that:

  1. The Customer has the legal authority to tender the Shipment for transportation.
  2. Information provided to Go Auto Freight is accurate and complete.
  3. The Customer will comply with applicable laws and regulations.
  4. The Customer will provide documents reasonably required for transportation.
  5. The Customer will disclose hazardous, oversized, overweight, or special transportation requirements.
  6. The Customer will not tender prohibited or illegal property.
  7. The Customer will cooperate with reasonable pickup and delivery procedures.
  8. If acting on behalf of another person or entity, the Customer has authority to do so.

Indemnification

To the maximum extent permitted by applicable law, the Customer agrees to defend, indemnify, and hold harmless Go Auto Freight LLC and its owners, officers, employees, agents, and representatives from claims, liabilities, damages, penalties, fines, costs, and reasonable attorneys’ fees arising from:

  • The Customer’s unlawful acts;
  • Materially inaccurate information supplied by the Customer;
  • Prohibited, hazardous, or undeclared property;
  • The Customer’s breach of these Terms;
  • The Customer’s failure to disclose material Shipment information; or
  • Acts or omissions attributable to the Customer.

This indemnification provision does not require the Customer to indemnify Go Auto Freight for liability that cannot legally be shifted to the Customer.

Limitation of Liability

To the maximum extent permitted by applicable law, Go Auto Freight shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, loss of business, loss of use, inconvenience, or similar consequential losses arising from or related to the brokerage services.

Where Go Auto Freight acts solely as a transportation broker, Go Auto Freight does not assume the Carrier’s responsibility for the physical transportation, possession, handling, or custody of the Shipment.

Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law.

Carrier Terms and Transportation Documents

The Carrier may issue its own: Bill of Lading, inspection report, rate confirmation, carrier agreement, tariff, transportation terms, delivery receipt, and other transportation documents.

The Customer should carefully review all Carrier documents before signing.

Carrier transportation documents may govern the relationship between the Customer and Carrier concerning the physical transportation of the Shipment, subject to applicable law.

Broker Transaction Records

Go Auto Freight maintains transaction records as required by applicable federal law.

To the extent provided by applicable law, parties to a brokered transaction may have rights to review applicable transaction records maintained by Go Auto Freight.

Go Auto Freight will handle requests for transaction records in accordance with applicable federal regulations and lawful contractual requirements.

Dispute Resolution

The parties agree to first make a good-faith effort to resolve any dispute, claim, or controversy arising from these Terms or services provided by Go Auto Freight through direct communication.

If a dispute cannot be resolved informally, either party may pursue remedies available under applicable law.

Nothing in these Terms is intended to prevent a Customer from exercising a legal right or remedy that cannot lawfully be waived.

Arbitration

No arbitration obligation is created by this section unless the parties separately enter into a valid written arbitration agreement.

If the parties separately agree in writing to binding arbitration, that arbitration agreement will govern the arbitration process and applicable rules.

Any arbitration agreement will be interpreted and enforced under applicable federal arbitration law and Texas law to the extent applicable.

Nothing in this section prevents a party from seeking emergency or provisional relief when such relief is available under applicable law.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, except to the extent that federal transportation law or another mandatory federal or state law controls a particular issue.

Because Go Auto Freight arranges transportation that may involve interstate commerce, applicable federal transportation laws and regulations may govern particular transactions.

Nothing in these Terms is intended to waive, limit, or override any mandatory provision of federal or state law.

Venue

To the extent permitted by applicable law, any court proceeding concerning these Terms or services provided by Go Auto Freight shall be brought in a court of competent jurisdiction in the State of Texas.

Nothing in this provision prevents a party from bringing a claim in another forum when federal law or another mandatory law requires or permits that forum.

Electronic Communications and SMS

By providing a telephone number or email address to Go Auto Freight, the Customer authorizes Go Auto Freight to use that contact information for transaction-related communications, including: quotes, booking confirmations, pickup coordination, delivery updates, shipment status, invoices, customer service, documentation, and other communications reasonably related to the Customer’s transaction.

Where legally required, promotional SMS or marketing communications will be sent only in accordance with applicable consent requirements.

Message and data rates may apply.

Customers may opt out of applicable SMS communications by replying STOP where supported.

Go Auto Freight does not sell SMS opt-in information to third parties for their independent marketing purposes.

Privacy

Go Auto Freight may collect and use information reasonably necessary to: process transportation requests, provide quotes, arrange transportation, communicate with Customers and Carriers, process payments, maintain business records, prevent fraud, resolve disputes, and comply with applicable legal requirements.

Customer information may be provided to Carriers, vendors, payment processors, technology providers, and other service providers when reasonably necessary to perform requested services or comply with legal obligations.

Go Auto Freight will handle personal information in accordance with its applicable Privacy Policy and applicable law.

Website Quotes and Online Information

Website pricing, estimates, calculators, forms, advertisements, and other online information may be based on information supplied by the Customer and may be subject to verification.

An online estimate does not necessarily constitute a final or guaranteed transportation rate until confirmed by Go Auto Freight.

Go Auto Freight reserves the right to correct obvious pricing, typographical, technical, or informational errors.

Changes to These Terms

Go Auto Freight may modify these Terms from time to time.

The Terms applicable to a particular transaction will generally be those accepted by the Customer at the time of booking, subject to applicable law and any separate written agreement governing the transaction.

Updated Terms may apply to future Orders after their effective date.

Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent legally permitted, and the remaining provisions shall remain in full force and effect.

No Waiver

A failure by Go Auto Freight to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision or any other provision in the future.

Entire Agreement

These Terms, together with the applicable Order Confirmation, invoice, rate confirmation, shipment documents, and other written agreements applicable to the transaction, constitute the agreement between Go Auto Freight and the Customer concerning the applicable brokerage services.

If a separate written agreement expressly conflicts with these Terms, the specific written agreement shall control to the extent of the conflict.

Customer Acceptance

By requesting transportation, submitting a booking request, approving an Order Confirmation, authorizing Go Auto Freight to arrange transportation, making payment, or otherwise proceeding with a Shipment, the Customer acknowledges that the Customer has had an opportunity to review these Terms and agrees to them to the extent permitted by applicable law.
